We offer a comprehensive range of services to the property sector, with our lawyers advising private developers, architects, construction companies and craftsmen. As with other areas of law, private building law requires a high degree of legal specialisation. As construction technologies and structural engineering become increasingly complicated, so too do the relevant laws and regulations applied to this field of practice.

v. Einem & Partner has many years of experience in this area, which directly benefits our clients. When entering into a building contract, all parties assume comprehensive legal obligations. It is therefore absolutely vital, from the onset, to structure the contractual relationships in order to safeguard one's own interests.

By providing comprehensive advice prior to contract conclusion and assistance in interest-based contract drafting, our team of lawyers tries to prevent any costly litigation ex ante. However, if and when required, we will of course represent our clients in court.

We advise our clients and represent their interests inter alia in the following areas:

  • Drafting and reviewing of building contracts as well as building developer and general contractor agreements
  • Handling of warranty claims arising from building contracts, assertion of claims for remuneration for a contract for work, legal services throughout the construction process
  • Land law and convincing, in particular legal advice regarding the conclusion of contracts
  • Real estate transactions both in Germany and abroad (with particular expertise throughout the Spanish-speaking region)
  • Law governing architects, including advice on the German Fee Regulation for Architects and Engineers (HOAI), enforcement of claims for payment of architect's fees, architect's professional liability, drafting and reviewing of sub-planner and co-management agreements
  • Regulations for awarding contracts
