Estate planning is an integral part of the comprehensive advisory services we provide to our clients. The personal, commercial, legal and taxation planning and structuring of business succession is vital whenever a changeover from one generation to another is imminent. We can advise you with regard to business succession planning, particularly in cases of family-owned companies for whom both the preservation and the future success of the company is of paramount importance.
In addition, we also offer advisory services for private estate planning, including the drawing up of wills, contracts of inheritance and the settlement of issues involving the compulsory portion of an inheritance, etc. The tax optimisation by way of making provisions for an anticipated inheritance plays a significant role in our advisory services for both corporate and private clients. Our goal is to prevent future conflicts by providing high-quality advice ex ante.
However, we also cover all issues concerning the distribution of an estate among coheirs and the enforcement of claims before the courts.
We advise our clients and represent their interests inter alia in the following areas:
- Drawing up and reviewing last wills and testaments as well as contracts of inheritance for individuals, spouses, de-facto relationships and entrepreneurs
- Analysis and preparation of provisions relating to succession in corporate agreements
- Development of precautionary plans, most notably:
- Precautionary powers of attorney
- Living wills (advance directives)
- Contractual structure and assumption of estate management
- Advice and assistance for all issues arising in cases of inheritance, in particular:
- Liaising with probate courts and other authorities
- Filing of inheritance tax returns
- Corrections to land register entries
- Drafting of agreements for the distribution of an estate among coheirs
- Settlement of claims to a compulsory portion or claims to a supplement to the compulsory portion
- Administration and execution of wills
