The increasing complexity of family law requires a high degree of specialisation in this field. v. Einem & Partner has many years of experience in this area, which directly benefits our clients.

The drafting of pre-nuptial and separation agreements play an important role in our practice. The relevant optional statutory provisions are necessarily based on a standard scenario and do not provide the most suitable matrimonial property regime for all married couples. In many cases, contractual agreements are required to supplement and amend the statutory provisions. We offer advice and assistance in the drafting of matrimonial property agreements, divorce settlements and de-facto partnership agreements.

In the events of separation or divorce, our specialists can assist you with regard to all questions of matrimonial property settlement, maintenance, custody and rights of access and visitation. As a matter of course, we also represent our clients before the courts.

We advise our clients and represent their interests inter alia in the following areas:

  • Drafting and reviewing of matrimonial property agreements, advice on matrimonial property rights and regimes and addressing questions of spousal maintenance and child support (also with regard to cases involving foreign jurisdictions)
  • Drafting divorce settlements, specifically for the purpose of settling matrimonial property issues and maintenance; determination of capability to pay maintenance in the case of self-employed persons
  • Drafting of de-facto partnership and domestic partner agreements
  • Assistance and representation, both in and out of court, with regard to maintenance, custody and rights of visitation and access

When drafting agreements, we take into consideration all material aspects of taxation law and law of succession as well as any problems that may arise from existing debts, joint property or corporate relationships.
