We advise property managers, commercial landlords and tenants in all aspects of commercial leasing. Successful conclusion of commercial leasing agreements and efficient implementation of contracts for business premises is of enormous financial importance for both commercial landlords and commercial tenants.

Whereas landlords need reliable arrangements to secure their leasing income, tenants are primarily focused on long-term protection of their business premises. In contrast to landlord and tenant law for residential properties, legislation on commercial leasing of business premises is not comprehensive; this makes it essential to obtain prior legal advice before signing such agreements. In this way, a sound and lasting basis can be created for the landlord-tenant relationship. Our main activities in the field of commercial leasing law are:

  • contract design and advice during negotiations
  • operating costs and enforcement of claims for payment
  • warranty rights in the case of defects in the leased object
  • termination and winding up of tenancies
  • representation in litigation

v. Einem & Partner also has many years of experience in advising and representing managers of condominiums. Our specialists handle representation in litigation, assist managers of condominiums and their employees in everyday business and give presentations at owner meetings. In tandem with specialists in building and real estate law, we provide advice on changes to buildings, on modernisation and refurbishment of condominium buildings, and enforce warranty claims against construction companies. Our other main activities in this field include:

  • design of property manager contracts
  • collection of monthly dues for condominiums, including execution measures
  • proceedings to set aside resolutions

Last but not least, we provide advice to landlords and tenants of residential properties. We prepare notices of termination for rented property and perform checks on statements of account for operating costs. Our main focus is on asserting rent increases and on representation in non-payment of rent and eviction proceedings.
